Sentencing for the multiple rape count convictions of Brandon Vandenburg and Corey Batey, has been postponed to April 24, 2015, so attorneys for both can begin new trials for a new round of clients. (Vandenburg was also convicted for unlawful photography and tampering with evidence.)
Also, at the request of Brandon Vandenburg’s California attorney, Alfred Perez, the hearing on Vandenburg’s charge of battery against California school personnel, has also been postponed.
Quick reminder: The name of the game in Defense is: Delay.
Quick reminder #2: The California charge occurred while Vandenburg was out on bail.
Palm Desert Charter Middle School was the scene of Vandenburg’s latest demonstration of,
“I do what I want when I want.”
Vandenburg had gone to Palm Desert presumably to pick up one of his brothers, but got into it with security guard Jamie Tarascio seconds after Tarascio informed Vandenburg he had to verify Brandon was on the list of “Emergency” contacts.
According to the police report, that information didn’t appeal to Brandon. As Tarascio turned to leave, Vandenburg went for Tarascio’s sunglasses. The grab resulted in a small scratch under Tarascio’s left eye.
Vandenburg then refused to return the sunglasses to Tarascio.
Vandenburg was then forcibly escorted/ejected from the school by personnel.
He left Tarascio’s glasses on top of a fence. Again, this occurred while Vandenburg was out on bail. Local reaction has been solidly, anti-Vandenburg.
Vandenburg was later charged with one count of misdemeanor battery against a school employee. A plea of “not guilty” was entered at an arraignment on Oct. 20, 2014.
We can expect the defense to request Palm Desert charges be dropped “in the interests of justice” after the Nashville sentencing.
Corey Batey, minus a disastrous appearance on Dr. Phil, has kept his nose clean.
McKenzie did very well with his testimony so I expect the DA’s office will agree to simple sexual assault… as promised. I don’t know TN’s criminal statute, but expect the least sentence… if the victim agrees.

What’s in store for the other two guys headed to trial. They have to be scared sh*tless given what happened to Corey and BV.

Tip will plead to aggravated sexual abuse and receive a six year sentence , hard time . Banks will plead to one count of aggravated rape and receive a fifteen year sentence , hard time . Those are my predictions. The DA has already said that Tip was the least culpable . Banks is looking at probable very harsh treatment . There will not be a trial for either .

Newest case is always the most important. Also, he knows his client is toast.
